FOI cost order against applicant
The NSW Administrative Decisions Tribunal (ADT) in Miriani v Commissioner for Fair Trading decided in favour of a award of costs against another FOI applicant where it was clear that the application for review had no merit. This case involved a new hearing of the application for costs after the Appeal Panel found that an earlier decision erred in law in failing to provide the FOI applicant an opportunity to make submissions.
