The Australian's FOI Editor, Michael McKinnon in "Secrets and lies" yesterday suggested that the unsuccessful High Court challenge regarding conclusive certificates may not be the final word on the subject. McKinnon said that some, including the Government's lawyers, saw scope in the High Court judgment to justify further action for judicial review by the Federal Court.
The Australian is calling for the establishment of an FOI fighting fund to underwrite such a challenge.
My view is that money and energy would be better spent in establishing a credible, professional representative body to promote and advocate open government principles, and FOI laws that work to achieve those objectives.
